Florida man claims he accidentally killed girlfriend with penis

In a very bizarre Florida murder case, the defense attorney made a request that the jury view his client’s penis as evidence.

Richard Henry Patterson, 65, of Margate, Fla. was charged in the death of his girlfriend, Francisca Marquinez, in 2015. Prosecutors say he choked her to death, then left her body in her apartment for several days before informing the police.

Patterson's attorney claims she died accidentally by choking during oral sex. The jury would more fully understand how the death occurred once they saw the penis, he argued.

The jurors were spared the experience after associate Broward County medical examiner Iouri Boiko questioned the theory and the defense withdrew the motion.

Instead, the defense argued that there was no way of knowing how she died. Medical examiners never determined the cause of death because Marquinez’s body was too decomposed.

Patterson was found not guilty of second-degree murder.
