Colin's sex tape stalls in court

Few releases are as anticipated as that of Colin Farrell's sex tape with former Playboy Playmate Nicole Narain. Unfortunately, fans anxious to catch a glimpse of Farrell in action will have to keep waiting because a California judge has barred Narain from releasing her 15-minute home-movie with Hollywood's favorite Irishman.

Los Angeles Superior Court Judge Elihu Berle dismissed Narain's request to throw out a lawsuit filed by Farrell last July that is preventing her from distributing their videotaped tryst.

Berle sided with Farrell this week when he ruled that there was sufficient evidence supporting Farrell's claim -- which states that the tape was understood to be for private viewing only and should therefore be protected from distribution -- to allow the trial to move forward.

"The judge took the position we pretty much expected he would take, but we had to narrow down some of the issues," Narain's lawyer, Leodis Matthews, told E! Online News.

Farrell claims that Narain breached an oral contract with him and is accusing her of invasion of privacy, violation of commone law right of publicity, unfair competition and unfair business practices.

Meanwhile, Narain has been trying to market her tape with adult website company Internet Commerce Group and says that Farrell's lawyers are making unsubstantiated copyright infringement claims. As co-creator of the tape, she argues that she has the legal right to distribute and profit from it.

Ultimately, however, a jury will decide who's right. According to E!, mediation for the trial is set to finish by April 20. If Narain and Farrell fail to solve their dispute, a jury will hear the case in July.

Until then, Farrell's fans can only hope for more X-rated leaks, such as that of several explicit stills and clips from the tape on Jan. 10. Of course, a leak of any kind from Farrell would make for a very happy St. Patrick's Day for all!
